National Academy of Customs, Indirect Taxes and Narcotics (NACIN) and National Academy of Direct Taxes (NADT) sign a Memorandum of Understanding (MoU) for sharing of resources

The National Academy of Customs, Indirect Taxes and Narcotics (NACIN) and the National Academy of Direct Taxes (NADT) today signed a Memorandum of Understanding (MoU) for sharing resources, such as best practices, expert faculty, training materials and innovative technologies.

The MoU was signed by Shri Jayant Diddi, Principal Director General (Trg.), NADT, and Dr. K.N. Raghavan, Director General, NACIN. Member Administration CBDT Shri Ravi Agrawal, Member (Administration and Vigilance), CBIC, Shri Alok Shukla, ADG, NACIN, Shri Ramesh Chander and other senior officers from both academies were also present.

NACIN and NADT mutually recognise the value of collaboration in sharing resources, such as best practices, expert faculty, training materials, and innovative technologies. This collaboration is keenly focused on areas of shared interest including taxation, law and legal systems, commercial and procedural laws, economic and administrative law, collaborative efforts, including sharing of resources and pedagogies in cutting edge Investigation Techniques such as Data Analysis, Dark Web Exploration and Risk Management and ethics fall within ambit of this MoU.

The MoU will facilitate both the Central Training Institutes to establish cooperation in sharing resources and best practices for the mutual benefit of officers from CBIC and CBDT and carries provision for reciprocal training programmes for officers of both services including a structured attachment of officer trainees. 

Central Board of Indirect Taxes and Customs (CBIC) and Central Board of Direct Taxes (CBDT) had signed a MoU on sharing of data in July 2020. Considering the dynamic nature of trade, there is a need for knowledge-sharing and capacity-building among the officers of two organisations. Current MoU would build up on the training needs of officers and focus on synergies for better revenue administration.

 

ABOUT NACIN

NACIN is the apex training institute established to train the Officer trainees of Indian Revenue Service (Customs & Indirect Taxes) and also imparts in-service training for all officers and cadres under the Central Board of Indirect Taxes and Customs (CBIC). The new campus of NACIN coming up at Palasamudram is expected to be commissioned shortly. NACIN is also contributing immensely in international capacity building in the areas of Customs, Drug Law Enforcement and other Indirect Tax related issues by way of training and exchange of other  capacity building resources with partner countries.

ABOUT NADT

NADT Nagpur is the apex training Institute established to train the Officer Trainees of Indian Revenue Service (Income Tax) and number of in-service courses for the middle to senior management level officials of the Central Board of Direct Taxes (CBDT).

Vice-President describes Chartered Accountants as finance form of MRI and CT scan

The Vice President of India, Shri Jagdeep Dhankhar today described Chartered Accountants as a finance form of MRI and CT scan and underlined that any dilution of their unique role would have cascading impact on the nation's economy and financial health.

Addressing the inaugural session of 'Global Professional Accountants Convention' in Gandhinagar,  Gujarat today, the Vice President stressed that tax evasion and financial frauds endanger the financial stability and economic growth of the economy. “As watchdogs your capacity is potent enough to contain these,” he told the Chartered Accountants present there.

Observing that a tax system is only as good or as complicated as tax professionals make it, he wanted all CAs to take a pledge to be global leaders in benchmarking best practices that enhance ease and transparency.

“Advising on tax planning is your domain. But this domain has a thin line. This should not extend to tax dodging and tax evasion,” he said. Describing the Chartered Accountants as the custodians of this thin line between tax planning and evasion, he asked them to “always tilt in favour of tax planning and condemn tax evasion.”

In his address, VP said that Chartered Accountants as the custodians of financial integrity need to exemplify by action to secure transparent and accountable financial systems. Asserting that there can be no legal transgressions or window dressing if a Chartered Accountant is so determined, Shri Dhankhar said, “You alone can do this. No one else can do this. This is your exclusive domain. When a CA stands up, the resistance may be momentary, ultimately he has to prevail.”

The Vice-President emphasized Chartered Accountants' crucial role in driving the nation's economic growth as ‘Nerve center & Epicenter of big change’ that shape what Bharat will be in 2047. He highlighted their contribution in combating corruption, uncovering malfunctions, and detecting corporate fraud. He stated that their determination could eliminate legal transgressions and window dressing practices.

Cautioning that ‘Compromising of Ethics is no less than an Earthquake in the fiscal world’, the Vice-President underscored that ethics play a pivotal role in fostering trust and integrity across financial reporting, auditing, taxation, and consulting services. Emphasizing the significance of a fair taxation and financial reporting system extending beyond mere revenue generation for the government, Shri Dhankhar praised that "CAs in Bharat have the highest 'Ethics Quotient'”, by making their clients adhere to Rule of Law. He also urged for a contemporaneous governance mechanism that can help Chartered Accountants unleash energy to attain public good and growth of the nation.

The Vice-President highlighted that the convention's theme, "Connecting the Globe, Creating Value," resonates with our economy's current dynamics. He emphasized its alignment with the G20 motto, "वसुधैवकुटुंबकम - One Earth, One Family, One Future.

The Vice-President noted that in today's ecosystem, transparency and accountability stand as new norms. The power corridors, once plagued by corrupt practices influencing commercial decisions, have undergone a cleansing process. He highlighted that with a zero-tolerance stance against corruption, the role of CAs flourishes. Noting that the adage, "Be you ever so high, the law is always above you," is now a ground reality, the VP stated that “the people who think they are above law, they are special category, they have learnt lessons and hard way”.

Reflecting on Gandhi Ji's words, "World has enough for everybody's needs but not everybody's greed," the Vice-President highlighted how some are driven by greed, not truly asleep but 'feign sleep.' He pointed out the ICAI's motto, "a person who is awake in those that sleep," aptly encapsulating the role of CAs in present times.

Talking about the importance of economic nationalism in trade and industry, the Vice-President emphasized its priority over fiscal gains. He appreciated the 'Vocal for Local' initiative by the government and highlighted how importing non-essential goods impacts foreign exchange reserves, hampers job creation, and obstructs entrepreneurial growth. Additionally he stressed that export of raw materials without value addition, leads to its adverse impact on employment opportunities and underscores the nation's inadequacy in engaging effectively in value addition processes. VP further urged CAs to nurture spirit of Economic Nationalism amongst the business industry.

The Vice President appreciated India's remarkable economic trajectory, transitioning from the 'Fragile-Five economies' to now proudly holding the fifth-largest global economy position in a short span of a decade surpassing the economic prowess of the UK and France in 2022. Shri Dhankhar further emphasized India's momentum toward surpassing Japan and Germany by 2030, leading the nation into the coveted position of the world's third-largest economy.

Referring to the GST as the "Tryst with Modernity", the Vice-President remarked that it stands as the largest tax reform since independence, completely transforming the country's indirect taxation landscape. He also praised the Chartered Accountants fraternity for their role in shaping Goods and Services Tax into the user-friendly 'Good and Simple Tax.'

Urging action towards harnessing recent technological breakthroughs like Artificial Intelligence, Machine Learning, Quantum Computing and Web 3.0, VP emphasized the imperative to unleash their potential. He further informed that substantial budgetary allocation has been made to the National Quantum Mission and Green Hydrogen Mission. Stressing the importance in this digital era, he highlighted the need for Chartered Accountants to actively align with the digital ecosystem, positioning them at its forefront. ‘The emergence of FinTech can be a case in point’, he noted.

The Vice-President acknowledged India is emerging as a global hub of financial and accounting processes in which Institute of Chartered Accountants of India (ICAI) has been playing a stellar role in building, standardising and sustaining the financial and accounting framework of the nation. In conclusion, the Vice-President expressed confidence ICAI will continue to make its mark on the global canvas for further enrichment and enhancement of the accounting and auditing standards and ethical integrity at national and global levels.

Rajasthan GST department constitutes “Coordination Committee” to meet once every quarter

The GST Council, in its 50th Meeting held on 11.07.2023, approved the creation of “Co-ordination Committee” in each State/UT comprising of GST authorities from the State and the Central Tax Administrations for better co-ordination among different  tax authorities.

2. Accordingly, a “Co-ordination Committee” (hereinafter referred to as ‘the Committee’), for the State of Rajasthan is hereby constituted, in consultation with the Chief Commissioner, State Tax, comprising of the following:

(a) Chief Commissioner, CGST & CX (Jaipur Zone), Jaipur (Co-chair);

(b) Chief Commissioner, State Tax, Jaipur (Raj.) (Co-chair);

(c) Ms. Babneet Tuli, Additional Commissioner, CGST & CX (Jaipur Zone), Jaipur;

(d) Sh. Mahesh Kumar Gowla, Special Commissioner (GST), State Tax, Jaipur (Raj.);

(e) Sh. Arvind Mishra, Advisor, Additional Commissioner (GST), State Tax, Jaipur (Raj.);

(f) Sh. Sandeep Kumar Payal, Deputy Director, DGGI, JZU, Jaipur;

(g) Assistant Commissioner, CGST & CX (Jaipur Zone), Jaipur. 

In the event of the transfer of any of the officers mentioned by name above, their controlling officers shall nominate new names to the Committee.

3. Term of the Committee- The Committee will function on perpetual basis. The Chief Commissioner of CGST/ SGST shall be Convener on rotational basis for one year each. In the first year, the Chief Commissioner, CGST shall be convenor. The Assistant Commissioner, CGST & CX (Jaipur Zone), Jaipur shall be the Secretary of the Committee during the tenure of the CC CGST as the Convenor. 

4. Functions and mandate of the Committee:

(a) The Committee shall engage in data sharing on important cases of evasion or audit, knowledge sharing and promote coordinated efforts in checking fake ITC cases, curbing tax evasion practices, sharing important audit paras & modus-operandi detected in Audit/Investigation, maintaining and updating contact details of field level officers and other GST related matters.

(b) Referring any issue requiring a change in Act/ Rules/ Notification/ Form/ Circular/ Instruction/ improvement on GST portal, etc., to the GST Council Secretariat and the relevant Policy Wing of the CBIC/ GSTN/ DoR.

(c) Make collaborative efforts on the issues pertaining to taxpayer facilitation as well as taxpayer grievances and conducting outreach programme. 

(d) To arrive at a uniform stand by the Central and State GST Administration in GST related petitions before any legal forum. 

(e) Co-ordination in Investigation/anti-evasion proceedings so as to ensure that on the same issue, investigations in respect of taxpayers are not undertaken by multiple administrations.

(f) Conducting a coordinated verification drive for suspicious tax payers at local level. 

(g) Any other GST matter deemed fit for coordinated work between Central and State Tax Administrations. 

5. Periodicity of Meeting of the Committee: The Committee shall meet once every quarter or as the Co-chairs may decide

Commerce Ministry to collaborate with e-commerce companies to promote exports from districts

In a significant move to enable micro, small and medium enterprises (MSMEs) and boost e-commerce exports from the country, Directorate General of Foreign Trade (DGFT), Ministry of Commerce and Industry, Government of India is collaborating with the various e-commerce players to leverage the Districts as Export Hubs initiative and promote e-commerce exports from the country. In first such collaboration with different e-commerce platforms, DGFT has signed a memorandum of understanding (MoU) with Amazon India.

As part of this MoU, Amazon and DGFT will co-create capacity building sessions, training and workshops for MSMEs in districts identified by the DGFT as part of the District as Exports Hub initiative outlined in the Foreign Trade Policy 2023, in a phased manner. The initiative seeks to link local producers even in rural and remote districts with global supply chains. The collaboration aims to enable exporters/MSMEs to sell their 'Made in India' products to customers internationally.

The MoU was signed in the presence of Shri. Santosh Sarangi (Additional Secretary and Director General, DGFT), Chetan Krishnaswamy (Vice President, Public Policy – Amazon) and Bhupen Wakankar (Director Global Trade – Amazon India).

The core objective of this collaboration is to leverage e-commerce platforms to support local exporters, manufacturers, and MSMEs in reaching potential international buyers. The partnership aligns with the Foreign Trade Policy 2023, which identifies e-commerce as a focus area for amplifying India's exports.

Under the collaboration, Districts will be identified by various e-commerce platforms across India, to undertake various capacity-building and outreach activities in collaboration with DGFT- Regional Authorities. These activities will focus on educating MSMEs on e-commerce exports and enabling them to sell to customers across the world. In addition, the capacity building session will allow MSMEs to learn about imaging, digital cataloging of their products, tax advisory amongst others. With this, Indian entrepreneurs can build their e-commerce exports businesses and global brands.  Under the MoU with Amazon India, 20 districts have been identified for such capacity building and handholding sessions.

DGFT is in discussion with various e-commerce platforms like Flipkart/Walmart, E-bay, Rivexa, Shopclues, Shiprocket, DHL Express etc. to have similar collaboration in other districts of the country under the Districts as Export Hubs initiative. This will supplement DGFT’s efforts to hand hold, promote new and first time exporters and other MSME producers to export from India, thereby making substantial strides towards the goal of $1 trillion goods exports by year 2030.

CGST Delhi East busts a syndicate of 48 fake firms availing fraudulent ITC of over ₹199 crores in “Operation Clean Sweep”, 3 arrested

The Central Goods and Services Tax (CGST) Delhi East Commissionerate has busted a syndicate of 48 interconnected fake firms availing fraudulent ITC of over ₹199 crores in “Operation Clean Sweep”. The CGST Delhi East commenced coordinated “Operation Clean Sweep” against fake billers, based on gathered human intelligence which was further developed through data mining and data analysis aided by on ground intelligence.

In the first wave of the operation, a total of 48 fake/bogus firms – either non-existent or paper firms – have been identified that were dealing in bogus invoices. Such invoices were made without the actual supply of goods or services, which is an offence under GST Law. Three persons were apprehended and arrested and subsequently sent to judicial custody remand for two weeks by the Chief Metropolitan Magistrate Court, Patiala House. Other members of the syndicate and the ring leaders have been identified and further investigation is being carried out.

 

One of the apprehended person who happened to be proprietor of M/s M.K. Traders was found to have availed fraudulent ITC of more than ₹5 Crores of which major portion had been passed on to other connected links. The other two apprehended persons were aiding and abetting the syndicate and instrumental in functioning of the syndicate. Incriminating material, including stamps belonging to 55 different firms, several SIM cards and documents like AADHAR cards, and electricity bills belonging to 3rd party were recovered during the operation.

The entire operation was conducted in difficult terrain, involving narrow by lanes and sensitive areas of Delhi – which was only possible due to amicable cooperation of Delhi Police which deployed adequate police personnel to assist the GST officers.

Further investigations are ongoing in the matter.
